Terms of Service

These Terms of Service ("Terms") govern your use of the LessonPlanningForTeachers service at lessonplanningforteachers.com (the "Service"), operated by Novastone AI LLC("Novastone," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a school or district, you represent that you are authorized to accept these Terms on its behalf.

1. The Service

LessonPlanningForTeachers generates draft lesson plans aligned to educational standards using artificial intelligence, structured on the 5E instructional model (Engage, Explore, Explain, Elaborate, Evaluate). Before content is stored or processed, an automated filter swaps names for labels and removes contact details and IDs. Generated plans are saved to your account library in that scrubbed form and remain until you delete them. Deleting a plan removes it and its materials from our systems for good.

2. Eligibility and Accounts

• You must be at least 18 years old and an educator, school staff member, or other adult professional to create an account.
• The Service is not directed at children, and students may not create accounts.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• Provide accurate account information and keep it current.

3. Acceptable Use

You agree not to:

• Input student personal data. Do not enter student names, identifiers, education records, IEP or 504 details, health or disciplinary information, or any other student personally identifiable information. The Service is designed to work fully without it, and our Terms require it.
• Use the Service for any unlawful purpose, or to generate content that is defamatory, discriminatory, harassing, sexually explicit, or promotes violence or self-harm.
• Attempt to reverse engineer, scrape, overload, or disrupt the Service, or probe its security controls.
• Resell, sublicense, or share your account access with others, except as permitted under a written district agreement with us.
• Misrepresent generated content as human-authored where such disclosure is required by your institution or applicable law.
• Use the Service to develop a competing product, or to benchmark it for publication without our written consent.

4. AI-Generated Content: Your Responsibilities

• Review before use. AI output can be inaccurate, incomplete, or misaligned. You are a professional educator: review every generated plan for accuracy, standards alignment, grade appropriateness, safety (including lab and activity safety), and suitability for your students before classroom use.
• No professional substitute. Generated content is a drafting aid, not professional, legal, medical, or psychological advice, and not a replacement for your judgment, your curriculum, or your district’s requirements.
• Standards disclaimer. We do not warrant that any plan satisfies any specific standard, rubric, observation framework, or district requirement. Standards references are provided as drafting assistance only.

5. Your Content and Ownership

• You own your output. As between you and Novastone, and to the extent permitted by law, we assign to you all right, title, and interest we may have in the lesson plans generated for you. You may use, adapt, print, and share them for educational purposes, including commercially (for example, on teacher marketplaces), subject to Section 4.
• Your inputs. You retain all rights in what you type. You grant us only the transient, limited right to process your inputs to generate your requested output.
• Similarity. AI systems can produce similar output for similar requests. Other users may receive similar plans, and you make no claim against them for it.
• Our property. The Service itself, including its software, design, branding, and prompts infrastructure, remains the exclusive property of Novastone AI LLC.

6. Subscriptions, Billing, and Cancellation

• Free tier. We offer a free tier with usage limits. We may change free-tier limits with notice.
• Paid subscriptions. Paid plans (including Founding Member subscriptions) are billed in advance on a recurring basis through our third-party payment processor and auto-renew until canceled.
• Founding Member pricing. If you subscribe at a Founding Member rate, that rate remains locked for as long as your subscription stays continuously active. If you cancel or your payment lapses and the subscription ends, re-subscribing later is at the then-current rate.
• Cancellation. Cancel anytime via the receipt link from our payment processor or by emailing support@lessonplanningforteachers.com. Cancellation takes effect at the end of the current billing period; you keep access until then.
• Refunds. Fees are non-refundable except where required by law. If we materially fail to deliver the Service, contact us and we will make it right, including by refund where appropriate.
• Price changes. We will give at least 30 days’ notice before any price change affecting a renewing subscription. Locked Founding Member rates do not change while continuously active.

7. Privacy and Data Practices

Our data practices are described in our Privacy Policy, which is incorporated into these Terms. The headline commitments: content is scrubbed of names before it is stored, we never train on or sell your content, and deleting a plan deletes it for good.

8. District Use and DPAs

Schools and districts may request a Data Processing Addendum at legal@lessonplanningforteachers.com. If a signed DPA conflicts with these Terms, the DPA controls for that district’s users. Individual teachers are responsible for confirming their use complies with their district’s technology policies.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT GENERATED CONTENT WILL BE ACCURATE OR ALIGNED TO ANY STANDARD, OR THAT CONTENT YOU HAVE DELETED CAN BE RECOVERED. DELETION IS PERMANENT, BY DESIGN.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVASTONE AI LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $50 IF YOU PAID NOTHING. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless Novastone AI LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your input of prohibited data (including student personal data) into the Service, or your use of generated content in violation of law or third-party rights.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms, with notice where practicable. Sections that by their nature should survive (ownership, disclaimers, liability limits, indemnification, governing law) survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Delaware, and both parties consent to their jurisdiction, except that either party may bring an individual claim in small claims court. You and we each waive any right to a jury trial and agree that claims may be brought only in an individual capacity, not as a class or representative action, to the extent permitted by law.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced by email or a prominent in-Service notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
